The authority indicated that it would ban and investigate OpenAI “immediately.” According to OpenAI, it complied with privacy regulations. Since its start in November 2022, ChatGPT has been used by millions of people. It can reply to questions in natural, human-like English and mimic other writing styles, with the internet as its library as it was in 2021. Microsoft has spent billions of dollars on it, and it was just recently added to Bing.

According to the statement, “mass collection and storage of personal data for the purpose of ‘training’ the algorithms underlying the platform’s operation’ is not supported by any legal basis.” Additionally, it stated that the app “exposes minors to absolutely inappropriate answers compared to their level of development and awareness” because there was no way to verify users’ ages. Due to similar concerns, Bard, a rival artificial intelligence robot to Google, is now only available to certain individuals over the age of 18.
Additionally, it has declared that it will integrate the technology in some way into Word, Excel, PowerPoint, and Outlook, which are all part of the Office suite. The potential risks of artificial intelligence (AI), including job loss and the dissemination of prejudice and false information, have been highlighted. Elon Musk and other prominent technologists called for the halt of these AI systems earlier this week, citing worries that the rush to develop them was out of control. In addition to halting OpenAI’s chatbot, the Italian data protection body promised to check to see if it complied with the General Data Protection Regulation.
The Italian data protection authority stated that OpenAI had 20 days to address the watchdog’s concerns or risk a sanction of up to 4% of annual revenues or €20 million ($21.7 million). In related news, the Irish Data Protection Commission told the BBC that it is pursuing the Italian regulator to understand the rationale behind their action and that it “will coordinate with all EU data protection authorities” in regards to the prohibition. The Information Commissioner’s Office, the UK’s independent data overseer, told the BBC that while it would “support” developments in AI, it would also “challenge non-compliance” with data protection laws.
According to Dan Morgan of cybersecurity rating service SecurityScorecard, the ban emphasises the importance of regulatory conformance for companies doing business in Europe. Businesses must value personal data protection and stick to the stringent data security laws set by the EU; compliance is not discretionary.
Consumer advocacy group BEUC has requested that EU and national authorities, including data-protection watchdogs, investigate ChatGPT and comparable chatbots following the submission of a protest in the US. The first AI legislation in the world is currently being developed by the EU, but BEUC is worried that it will take years for it to go into action, placing consumers at risk from an unregulated technology. Ursula Pachl, deputy general director of BEUC, issued a warning that society is “currently not sufficiently protected from the harm” that AI can cause. Concerns about how ChatGPT and other chatbots might mislead and influence people are increasing. She asserts that “public authorities must reestablish control over these AI systems and require more public scrutiny.”
Several countries have already banned ChatGPT, including China, Iran, North Korea, and Russia. OpenAI claims that at the request of the Garante, the Italian data security agency, it deactivated ChatGPT for customers in Italy: The business claimed that it was “committed to protecting people’s privacy and believes we are in compliance with GDPR and other privacy laws.” Because the organisation wanted its AI systems to “learn about the world, not about private individuals,” it worked to limit personal data when training AI systems like ChatGPT.
